2. Transfer of data to third countries

Via Vital Group LLC is based in the United States. When you visit this website or contact us, data may be processed on servers located outside the European Union, in particular in the USA. For such transfers we rely on standard contractual clauses pursuant to Art. 46 GDPR or comparable safeguards to ensure an adequate level of protection.

3. Data collected when visiting the website

When you visit our website, our hosting provider automatically records information in so-called server log files. This includes browser type and version, operating system, referrer URL, host name of the accessing computer, time of the server request and IP address. This data cannot be attributed to specific individuals. The legal basis is our legitimate interest in a technically flawless presentation and optimisation of our website (Art. 6 (1) (f) GDPR).

4. Cookies

Our website uses only technically necessary functions. We do not use advertising trackers or analytics cookies. Technically necessary cookies are required to operate the website; the legal basis is Art. 6 (1) (f) GDPR. You can disable cookies in your browser settings at any time.

5. Fonts and external services

We use Google Fonts, a service provided by Google Ireland Limited, to display typefaces. When the fonts are loaded, your IP address is transmitted to Google. The legal basis is our legitimate interest in a consistent and appealing presentation (Art. 6 (1) (f) GDPR).

6. Hosting

Our pages are delivered via a worldwide server network and are fully SSL encrypted. The hosting provider processes the data mentioned under point 3 on our behalf.

7. Contacting us

If you contact us by email, phone or messenger, we process the data you provide (name, contact details, request) in order to handle your enquiry and any follow-up questions. The legal basis is Art. 6 (1) (b) GDPR for pre-contractual measures and Art. 6 (1) (f) GDPR for other enquiries. The data is deleted once it is no longer required for the purpose of processing, at the latest after three years, unless statutory retention obligations apply.

8. Contact via WhatsApp and messengers

We also offer contact via WhatsApp. WhatsApp is a service of WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, a company of the Meta group. When you use WhatsApp, connection and usage data are transmitted to Meta and may also be processed in the USA. We have no influence on this processing. The same applies to Telegram (Telegram FZ-LLC, Dubai). If you would rather not use a messenger, email and telephone are available as alternative ways to reach us.

9. Data of your website

When creating and maintaining your website, we process the content, texts and images you provide exclusively for the purpose of fulfilling the contract. The legal basis is Art. 6 (1) (b) GDPR.

10. Your rights

You have the right to information (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR), objection to processing (Art. 21 GDPR) and withdrawal of consent with effect for the future (Art. 7 (3) GDPR) at any time. Please send your request informally to datenschutz@viavitalgroup.de.

11. Right to complain

You have the right to lodge a complaint with a data protection supervisory authority regarding the processing of your personal data (Art. 77 GDPR).

12. Data security

We use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our website uses SSL encryption, recognisable by the padlock symbol in your browser bar.

13. Status and changes

Status: July 2026. We reserve the right to adapt this privacy policy if this becomes necessary due to new technologies, changes in the legal situation or adjustments to our website.

Terms and conditions

1. Scope

These terms and conditions apply to all contracts between Via Vital Group LLC, 30 N Gould Street, Suite N, Sheridan, WY 82801-6317, USA, trading under the brand “Herzstück Web” (hereinafter “Herzstück Web”), and its clients (hereinafter “client”) regarding the creation, publication and ongoing care of websites. Deviating, conflicting or supplementary terms of the client only become part of the contract if Herzstück Web has expressly agreed to their validity in text form.

2. Conclusion of contract

Offers by Herzstück Web are non-binding unless expressly designated as binding. The contract is concluded upon order confirmation in text form, at the latest when the client approves the website. Verbal side agreements require confirmation in text form to be effective.

3. Scope of services

Herzstück Web creates an individually designed website for the client and handles its publication and ongoing care. The monthly fee includes in particular: design and build of the site, creation or refinement of texts and images, hosting, SSL security certificate, technical setup of legal notice and privacy information, registration with Google as well as smaller changes and adjustments. Smaller changes are generally processed within 24 hours of receipt of the request. There is no entitlement to a specific economic result, in particular no specific visitor numbers, search engine rankings or revenues.

4. Additional services

Larger rebuilds, additional subpages or special requests are not part of the monthly fee. They are agreed separately before execution and invoiced at the fixed price stated. The client always learns the price before work begins.

5. Client cooperation and content

The client provides all information, texts, images and access data required for the creation in good time. The client warrants that they hold the necessary rights to all content they provide and that this content does not violate applicable law or third-party rights. The client indemnifies Herzstück Web against third-party claims arising from the use of content they have provided. Delays due to missing or late cooperation are not at the expense of Herzstück Web.

6. Fees, start of contract and payment

The monthly fee is CHF 25. As Via Vital Group LLC is a foreign company, no German VAT is shown. For consumers this is a final price; for businesses the reverse-charge procedure may apply depending on their location.

The contract always begins on the first day of the calendar month following publication. For example, if the website goes live on 20 August, the first billing month starts on 1 September. The days until the first of the month are free of charge for the client. No retroactive billing takes place.

Payment is made monthly in advance, by bank transfer, credit card or PayPal.

7. Late payment

If the client falls into arrears, Herzstück Web will first send a reminder in text form. If two consecutive monthly fees remain unpaid, Herzstück Web is entitled, after prior notice, to temporarily take the website offline until the outstanding amount has been settled. The obligation to pay the agreed fees remains unaffected. The website data will not be deleted during this time.

8. Term, cancellation and file package

The contract is concluded for an indefinite period. There is no minimum term. Either party may cancel with one month's notice to the end of the month. Every cancellation must be in text form; an email or message is sufficient. The right to extraordinary termination for good cause remains unaffected.

For the duration of the contract the website remains published on the servers of Herzstück Web and is continuously maintained. When the contract ends, publication is discontinued.

Moving to another provider: There is no entitlement to the release of the website files. When the contract ends, publication is discontinued; no costs arise for the client. If the client wishes to run their website with another provider, they take it with them and receive it as a complete file package (ZIP file), ready to publish.

The basis of calculation is the creation value stated in the contract. Depending on scope it is 2,999, 3,999 or 4,999 francs; for particularly extensive work it is agreed individually. Of this value the following is charged: within the first contract year 120 percent, after one year 100 percent, after two years 80 percent, after three years 60 percent, and after five years permanently 20 percent. The uninterrupted duration of the care relationship at the time of the request is decisive.

Transferred are the design and the source code of the website. The client’s content, texts, photographs, logo and domain belong to the client at all times anyway and are not part of the takeover. The care relationship may be continued after a takeover if desired.

9. Rights of use

Upon full payment of the fees due, the client receives a simple right of use, unlimited in time and territory, to the website created for them, including the texts and graphics created specifically for them. Once the client has received the file package under clause 8, they may also operate and further develop the website with another provider. Rights to tools, templates and general design components that Herzstück Web also uses for other clients are not transferred.

10. Domain and external costs

The domain belongs to the client and is paid for by them. On request, Herzstück Web handles registration and technical setup. Further third-party costs, for example for paid images or external services, are borne by the client after prior agreement.

11. Reference

Herzstück Web is entitled, after prior agreement, to show the website created as a reference on its own website and in its own marketing materials. The client may revoke this at any time in text form.

12. Availability

Herzstück Web strives for the highest possible availability of the website. Short interruptions due to maintenance, technical faults at the hosting provider or events beyond our control do not give rise to any claim for reduction or damages.

13. Liability

Herzstück Web is fully liable for intent and gross negligence as well as for damages resulting from injury to life, body or health. In cases of slight negligence, Herzstück Web is liable only for the breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the client may regularly rely. In such cases liability is limited to the foreseeable damage typical for this type of contract. Any further liability, in particular for lost profits, indirect and consequential damages, is excluded to the extent permitted by law.

14. Force majeure

Events of force majeure, in particular natural disasters, pandemics, official orders, power failures as well as internet or telecommunications outages, release the parties from their obligation to perform for the duration of their effect.

15. Final provisions

The contractual relationship is governed exclusively by Swiss law, excluding the CISG. In relation to consumers, the mandatory consumer protection provisions of their country of residence apply in addition. The exclusive place of jurisdiction for disputes with businesses is Chur, Switzerland, to the extent permitted by law. Amendments and additions require text form. Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected.

Right of withdrawal for consumers

This notice applies exclusively to consumers, i.e. natural persons entering into the contract for private purposes. Businesses have no right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Via Vital Group LLC, 30 N Gould Street, Suite N, Sheridan, WY 82801-6317, USA, email: design@viavitalgroup.ch) of your decision by means of a clear statement, for example by email or letter. Sending the notification in good time is sufficient to meet the deadline.

Consequences of withdrawal

If you withdraw from this contract, we will refund all payments received from you without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal. For this refund we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you.

Early start of work

If you expressly request that we begin work on your website before the withdrawal period expires, you must pay us a reasonable amount corresponding to the proportion of services provided up to the point of withdrawal. We will point this out to you separately before work begins and obtain your consent.
